JAXMORE SUMMER REFRESH PHOTOGRAPHY AGREEMENT

1. Agreement

This agreement is between KTBB Limited trading as JaxMore Food and Drink Photography, registered in England and Wales under company number 08828493 (“JaxMore”), and the individual or business making the booking (“the Client”).

By completing a booking and making payment, the Client confirms that they have read, understood, and agree to these Terms and Conditions.

2. Services

JaxMore will provide the photography on location, editing and provision of finished image files.

Services will include:

- 2 hour location shoot

- c15 dishes

- Landscape and portrait version of each shot

- Print and Online files for each image

- Perpetual UK licence

- £100 credit for a Halloween or Christmas shoot

The venue, and deliverables shall be those agreed in writing at booking.

The shoot date and time will be agreed with the Client and confirmed in writing, as soon as possible after booking.

3. Booking and Payment

Full payment is required at the time of ordering.

No order shall be confirmed until payment has been received successfully.

We'll contact you within one working day of booking to arrange the date and time of the shoot.

5. Cancellation and Rescheduling

Photography sessions are arranged specifically for the Client and reserved exclusively for the agreed date and time.

The Client may request to reschedule a booking by providing at least 48 hours’ notice by email. JaxMore will make reasonable efforts to accommodate an alternative date, subject to availability.

Bookings cancelled by the Client are non-refundable.

Where less than 48 hours’ notice is provided, JaxMore reserves the right to refuse rescheduling and treat the booking as cancelled.

If JaxMore is unable to carry out the booked session due to circumstances within its reasonable control, JaxMore will arrange an alternative session date.

Where the session cannot reasonably proceed due to circumstances beyond the control of both parties, including severe weather, venue closure, or government restrictions, both parties will work together to rearrange the session where possible.

6. Client Responsibilities

The Client shall ensure that:

- the venue is accessible at the agreed time

- dishes intended for photography are prepared and available

- all permissions required for photography have been obtained

- a suitable representative is available during the session if required

Delays caused by lack of preparation or restricted access may reduce the amount of photography achievable during the booked session.

7. Editing and Delivery

JaxMore will edit and deliver the agreed final images within two working days.

One reasonable round of minor amendments is included.

RAW files and unedited captures remain the property of JaxMore and will not be supplied unless agreed separately in writing, and will incur additional costs.

8. Copyright and Usage

Copyright in all photographs remains the property of JaxMore.

Upon delivery, the Client receives an exclusive, perpetual UK commercial usage licence for the delivered images within the purchased package.

Images may not be resold, sublicensed, or materially altered without written permission from JaxMore.

JaxMore reserves the right to use the photographs, the Client’s business name, and the fact that services were provided for portfolio use, social media, marketing, publicity, awards, website use, and promotional activity connected with JaxMore.

9. Liability

JaxMore shall maintain appropriate public liability and professional indemnity insurance.

JaxMore’s total liability under this agreement shall be limited to the total amount paid by the Client.

JaxMore shall not be liable for indirect or consequential loss, including loss of revenue, bookings, or business opportunity.

10. Force Majeure

Neither party shall be liable for failure to perform obligations where such failure results from circumstances beyond reasonable control, including severe weather, transport disruption, venue restrictions, equipment failure despite reasonable precautions, or government restrictions.

11. Governing Law

This agreement shall be governed by the laws of England and Wales.
